Overview and Information Collected

This policy governs the information we collect via our Site and Software.

We gather two types of data. The first category includes details that can identify you personally—such as your name or email address (“Personally Identifiable Information” or "PII"). The second category consists of non-identifying data (“Non-Personally Identifiable Information” or "NPII"), which, although related to you, cannot be linked directly to your identity.

"Content" refers to the information and instructions provided for converting your files and video media, which we offer free of charge on the Site. You may also download and install the whatisnearme.net Software or related add-ons/extensions from various sources, including social media. The Software enables us to display different types of advertisements—such as text links, lightboxes, new tabs, pop-unders, videos, and banners—based on the content you view. Additionally, our Site, Content, and Software might display ads or contain links to external websites owned by third parties. All such external applications and advertisements are collectively referred to as "Third Party Content".

Third Party Content is incorporated to help support whatisnearme.net. Any interactions you have with Third Party Content—including engaging with advertisements, clicking links, or making purchases—are strictly between you and the external provider. Consequently, we do not endorse any products, services, or materials offered by these third parties. If you interact with Third Party Content, please be aware that their own privacy policies and terms will govern your relationship with them, and they may collect PII or NPII about you.

Collection of Personally Identifiable Information (PII)

We collect PII on the Site when you voluntarily provide it through our Contact Us page, where we ask for your name and email address to respond to your inquiries. Our Software is designed not to intentionally collect PII (please see “Use and Sharing of Personally Identifiable Information” below for details).

If you do not wish for us to collect or use your PII as described in this policy, please refrain from submitting it through the designated Site features. By providing your PII, you consent to its use and sharing as outlined here and in any future updates to this policy.

Updating Your Personally Identifiable Information

If your PII changes or you decide to stop using our services, you can update, correct, or remove your information by emailing our Customer Support at support@whatisnearme.net or by contacting us through our Contact Us page.

We retain your information for as long as your account is active or as long as needed to provide you with our services. Additionally, we may keep and use your data to comply with legal obligations, resolve disputes, and enforce our agreements.

Social Media (Features) and Widgets

Our Site may include social media elements such as Facebook Like buttons and interactive widgets like Share buttons or mini-applications. These features may collect your IP address, track which pages you visit, and set cookies to function properly. Whether hosted by us or by third parties, your use of these features is governed by the respective provider’s privacy policies.

Children's Privacy

Our Site and Software are intended for individuals aged 18 and older. We do not intentionally collect PII from anyone under 18. If we become aware that a minor has provided us with PII, we will promptly take steps to delete that information.

Use and Sharing of Personally Identifiable Information

We may use your PII for the purpose it was provided, for any additional purposes communicated at the time of collection, or as otherwise specified in this policy. However, any PII inadvertently collected by our Software is not utilized, and we continuously update our Software to detect, remove, and block such unnecessary data.

We will not share, sell, or trade your PII with third parties beyond what is described in this policy. Your PII may be shared with our principals, employees, consultants, agents, subsidiaries, affiliates, or our parent company (collectively “Related Companies”). Neither we nor our Related Companies participate in shared databases that grant other companies access to your PII.

We and our Related Companies may disclose your PII if required by law, to comply with a court order, to assist law enforcement, to prevent misuse of our Site, Content, or Software, or to protect our rights and the safety of our users and the public.

We may also share your PII with external service providers and consultants who help us deliver our services. For example, such partners may assist with managing customer databases, direct marketing, data storage and analysis, fraud prevention, telephone customer support, or other functions aimed at enhancing our services. These external parties are required to maintain the confidentiality of the information and to use it only for the purposes of fulfilling their obligations to us.

Furthermore, in the event of a business transition—such as a merger, acquisition, or sale of assets—your PII may be transferred as part of that transaction. If such a change occurs, we will notify you with a prominent notice on the whatisnearme.net home page.

Non-Personally Identifiable Information (NPII)

Like many websites, our Site automatically collects certain technical data from your device (such as IP address, browser type, operating system, timestamps, and landing pages) and stores it in log files. This information helps us tailor your experience, improve our Site’s performance, and ensure smooth navigation. Additionally, we collect your IP address to diagnose server issues and for Site administration purposes.

In addition to the basic collection of NPII, our Software may gather additional details including your IP address, browser specifications, operating system, visited URLs, and page content. We use this information to deliver more relevant Third Party Content and may collaborate with advertising networks to serve ads better suited to your interests. Your NPII or aggregated data may be shared with these partners to enhance ad relevancy and support other business functions. These partners might also use cookies and similar technologies to collect demographic data and track internet activity. If you wish to permanently stop receiving such targeted Third Party Content, please uninstall the Software and cease using the Site, as detailed in the "Removal" section below.

You may opt out of having your NPII used by members of the Network Advertising Initiative (“NAI”). The NAI opt-out tool has been created to allow you to avoid behavioral advertising from NAI members. Opting out does not eliminate all ads; it simply prevents NAI members from serving ads specifically tailored to your browsing habits. This choice is maintained via "opt-out cookies," so if you clear cookies, switch browsers, or change devices, you may need to opt out again. For more details or to opt out, please visit http://www.networkadvertising.org/choices.

Cookies / Tracking Technologies

Our Site and Software use cookies and similar technologies to collect aggregate internet traffic data and to enhance your experience. A cookie is a small text file stored on your device by a web server, containing data that can later be read by that server. Cookies do not execute programs or transmit viruses. They are used to remember your preferences and temporarily store session data, which helps us present personalized content and advertisements on future visits. If you prefer not to accept cookies, you can configure your browser to reject them or notify you when a cookie is being set. You can also manually delete cookies from your browser (instructions available for Firefox, Chrome, Safari, and Internet Explorer). We do not link any PII to the cookies we set.

Additionally, third-party partners who provide certain features or advertising on our Site might use local shared objects (LSOs) such as HTML5 and Flash to collect and store information. For guidance on managing Flash cookie settings, please follow the provided instructions.

Third Party Cookies

Cookies used by our third-party advertisers and ad servers are not covered by this Privacy Policy. We do not control these cookies, and they may use session IDs to collect anonymous data.

Web Beacons

Our Site may include web beacons (also known as single-pixel GIFs) which help deliver cookies, track visitor activity, and support our services. In cases where a partner advertises on our Site, we may work with them to install web beacons on their website to measure the effectiveness of their ads. Additionally, third-party web beacons may be used to aggregate data on our promotional efforts. Rest assured, we do not allow unauthorized third parties to use web beacons on our Site to collect or access your PII, and we do not associate them with any PII you provide.

Use and Sharing of Non-Personally Identifiable Information (NPII)

We do not share, sell, or trade your NPII with third parties beyond what is described in this policy. Your NPII may be shared with our Related Companies, but neither we nor they participate in databases that allow external companies to access your NPII.

We and our Related Companies may disclose your NPII to third parties if legally required, to comply with court orders, to assist law enforcement, to enable third-party ad networks to deliver more relevant ads, or to protect our rights and services.

Similarly, we may share your NPII with external consultants and companies that assist us in delivering our services. Such collaborations might include managing customer databases, assisting with marketing, providing data storage and analysis, preventing fraud, offering phone support, or other functions. These external parties are required to maintain the confidentiality of your data and use it solely to fulfill their obligations to us.

Furthermore, in the event of a business transition—such as a merger, acquisition, or asset sale—your NPII may be among the assets transferred. If this occurs, we will notify you via a prominent notice on the whatisnearme.net home page.

Security

We have implemented a range of technical, administrative, and physical security measures to safeguard your information from unauthorized access or misuse. Your data is stored on servers protected by firewalls in secure facilities accessible only to authorized personnel. We regularly review and update our security practices to incorporate new technologies and methods. However, please note that no security system is entirely foolproof, and any information transmitted to or through our Site is at your own risk.

Removal

If you have installed the Software and do not want your NPII to be collected as described above, please uninstall the Software immediately. You can do so by following the directions provided here to remove the Software from your device.

Your California Privacy Rights

Under California Civil Code Section 1798, California residents have the right to inquire whether a business has disclosed their Personal Information to third parties for direct marketing purposes. As stated in this Privacy Policy, we do not sell or share your Personal Information with unaffiliated companies for their direct marketing without your consent. California residents seeking more information about our compliance or wishing to express concerns about our privacy practices should contact us by email at support@whatisnearme.net. Please allow up to 30 days for a response.

Changes to this Privacy Policy

If we update our privacy practices, we will post the changes to this Privacy Policy or in other prominent locations so that you are aware of what data we collect, how we use it, and under what circumstances it may be disclosed.

We reserve the right to modify this Privacy Policy at any time, so we encourage you to review it regularly. If material changes are made, we will notify you here or via a notice on the Site’s home page before the changes become effective. The date at the bottom indicates the last update.
